President Serdar Berdimuhamedov has signed a new law regulating scientific intellectual property in Turkmenistan. The document, published in the newspaper “Neutral Turkmenistan,” outlines the legal framework governing the creation, use, and protection of scientific intellectual property assets.
Under the new legislation, scientific intellectual property encompasses monographs, dissertations, research reports, scientific articles, presentations, and related methodological materials. The law also recognizes intermediate, final, and derivative results of scientific work as forms of intellectual property.
According to the law, ownership rights to scientific developments belong to their creators, though they may be transferred to employers through contractual agreements. Developers of scientific intellectual property are entitled to remuneration and a share of profit derived from the use of their works.
The law allows the transfer of rights to third parties and permits the use of these rights as contributions to the charter capital of enterprises. Rights holders may seek compensation if their intellectual property rights are violated.
Funding for activities in the field of scientific intellectual property will come from the state budget, off-budget sources, and income generated by research institutions through economic activities.
The law takes effect from the date of its official publication.
